Supreme Court has started hearing about historical same-sex marriage legalisation. Many organisations that represents Queers of India wanted this monumental verdict to go their way. Same-Sex marriage legalisation would remove the taboo attached to queers, they stated. Supreme Court after hearing has decided to talk about legality and humanity behind the issue. They have stated that queer couples have right to cohabit. Supreme Court denied legalisation of same-sex marriage.
They have stated that only legislature can legalise and it is not in their jursidiction. But Supreme Court has given a go-ahead to high-committee proposed by the Central Government in May. This committee will give recommendations to Central Government about the same-sex marriage legalisation. Supreme Court has stated that queer couples and unmarried live-in couples can adopt children, if they wish to. But they have strongly stated that right to marriage is not a fundamental right stated in Constitution.

Hence, in this matter, they cannot have the final say. Supreme Court has asked people to be more considerate towards queers. They have stated that cohabitation is not illegal, hence, people should not talk about it as illegal matter. Supreme Court judgement did not satisfy queers. They wanted legalisation of same-sex marriage by the Apex court. They wished at least Apex Court to direct Government to take fast action in this issue. For now, Supreme Court did not feel like they have right to force or influence legislation in this issue.
